The privacy and security of personal information is very important to Canature WaterGroup Inc. and its affiliates (“CWG”). Who Does This Policy Apply to?

This Privacy Policy applies to Canature WaterGroup Canada Inc., Canature WaterGroup USA Inc. and this website.

Why does CWG collect personal information?

CWG may collect personal information for the following purposes:

  • To administer, plan, and manage the relationship with individuals and to communicate with individuals;

  • To provide individuals with requested information, products, and/or services;

  • To better understand how CWG may improve its products and services, to develop and conduct its business and operations, and for other internal business purposes;

  • To provide individuals with information on current and future products and services or other developments with respect to CWG and its affiliates and partners (in accordance with Canada’s Anti-Spam Legislation – see below); and

  • To comply with applicable legal and regulatory requirements or to protect CWG’s legal rights and property;

(collectively, the “Authorized Purposes”).       

The type of information that CWG may collect from individuals includes, for example, name, email address, address, phone number, and other information individuals choose to provide. Financial information is also collected by CWG’s service providers when you purchase products and services from CWG.

CWG may collect personal information for other purposes where it has a legal duty or right to do so or where CWG has a good faith belief that it is necessary to protect the property or rights of CWG.

CWG does not collect personal information for any other purposes, unless it has the consent of the individual to whom it relates.

How does CWG collect personal information?

CWG only collects personal information about an individual with the individual’s knowledge and consent. Generally, this means that CWG collects personal information directly from the individual to whom it relates, whether via CWG’s website, e-mail, telephone, fax, or in person. Occasionally, CWG may collect personal information from third party sources, but only with the knowledge and consent of the individual or where otherwise authorized by law.

Visitors to CWG’s website should also be aware that anonymous technical information may be collected by CWG as a result of a visit to CWG’s website. For example, this information may include the visitor’s IP address, browser type, operating system, domain name, access times and referring website addresses. CWG uses this anonymous technical information for purposes such as diagnosing problems with CWG’s servers, improving the operation and content of CWG’s websites and compiling aggregate and statistical information.

CWG will not attempt to link or match such anonymous technical information with any personally-identifiable information unless CWG has an individual’s consent, CWG (or its service providers) have detected or reasonably suspect any unlawful use of CWG’s services or a security breach, or CWG has a legal duty or right to do so.

CWG uses “cookies” on its website. “Cookies” are small text files placed on computers that can collect and store a variety of information. Permanent cookies are stored indefinitely on a user’s hard drive unless manually deleted, while temporary cookies are automatically deleted from the user’s browser upon logging out of a website. Web browsers typically allow users to disable permanent and/or temporary cookies.

When does CWG use or disclose personal information?

CWG only uses or discloses personal information as reasonably required to facilitate the Authorized Purposes listed above.

In some cases, CWG may share personal information with third party service providers performing functions on CWG’s behalf, including, for example, vendors that provide information technology services or provide analytics or assessment services.

CWG does not otherwise use or disclose personal information unless CWG has an individual’s consent, CWG has a good faith belief that disclosure of the information is necessary to protect the rights or property of Company, or CWG has a legal duty or right to do so.

CWG does not rent, sell or trade customer lists or other personal information.  

Consent – Is there a choice?

Individuals provide their consent to the collection, use, and disclosure of personal information by CWG when they provide their information to CWG or use its products or services.

Individuals can deny or withdraw their consent to CWG’s collection, use and disclosure of their personal information at any time upon reasonable notice, subject to any legal or contractual requirements. However, if consent is denied or withdrawn, CWG may not be able to provide certain products or services.

CWG and its affiliates may use personal information to inform individuals of current and/or new products or services or other developments that CWG or its affiliates or partners believe will be of interest to individuals in accordance with applicable laws including Canada’s Anti-Spam Legislation. Such communications may be made by way of telephone, text message, direct messaging, e-mail, fax or regular mail. Individuals provide their consent to CWG and its affiliates and partners contacting them in this manner when they use CWG’s products or services. How does CWG protect the security of personal information?

CWG has in place reasonable policies, procedures and safeguards (including physical, technological and organizational measures) designed to protect the security of personal information under its control.

The protection of personal information is of paramount concern to CWG, and CWG is prepared to take appropriate and timely steps in the event of any incidents involving personal information in accordance with applicable privacy laws.

CWG makes every reasonable effort to ensure that personal information is accurate and complete. This may involve requesting further information or updates from individuals. CWG relies on individuals to notify CWG if there is a change to their personal information that may affect their relationship with CWG.

CWG retains personal information only as long as is reasonable to fulfill the purposes for which the information was collected, or for legal or business purposes.

Does CWG provide access to personal information?

CWG will provide individuals with access to the personal information CWG holds about them in accordance with applicable laws. CWG reserves the right to require that any request for access to personal information be made in writing. Generally, there is no cost for such access. However, CWG reserves the right to charge such costs on a case-by-case basis in accordance with applicable laws. The individual will be notified in advance if charges apply.

CWG will correct or amend the personal information in its files where it can be shown that the information is incorrect or incomplete.

Education information professional or employment-related information – education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records.Current or past job history or performance evaluations.

Inferences drawn from other personal information Education information – Profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records.

2. The information we collect about you.

The information we collect about you and your use of our Application can include personal information (as described below) or non-personal information, which is information that does not identify or relate to an individual.

Personal information is information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual, household or device (“personal information”). Personal information does not include publicly available information from government records, deidentified or aggregated information, or health or medical information.

When and how do we collect your information?

We collect information from you both when you provide it voluntarily and also automatically when you use our Application, depending on your Application settings. The personal information we receive relates to your use of our Application in connection with an [Aqua Alert™] product that you have purchased or use.

In some instances, we automatically collect certain types of information when you use our Application or correspond with us. Automated technologies may include the use of web server logs to collect IP addresses, “cookies” and web beacons.

  • This application collects location data to enable the Aqua Alert app to connect with your water conditioning system. Once the app has paired with your valve, you can disable the collection of location data by choosing “Ask Next Time” or “Never” in the Location Settings of the App (by clicking on Aqua Alert in your iPhone Settings). If the App loses connection with your valve (e.g. power outage), you will need to turn the location data back on before pairing the App with your system again.
  • Our Application may use cookies, unique identifiers and similar technologies to collect information about the Application functions that you access, the buttons and icons you click, and to remember your login information and Application settings to make it easier and more efficient for you to use our Application. You can choose whether to accept cookies by changing the settings on your browser or device. However, if you choose to disable this function, your experience with our Application may be impaired and some features may not work as they were intended.
Anonymized InformationWe use anonymized and aggregated information that may be created or derived from your personal information or usage of our Application for purposes that include data analysis, improving our Application, advertising, and developing new features and functionality within our Application.

We will only use your information for the purposes identified below, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose described here.

Aqua-Alert uses Jiguang Push to send push notifications to user devices. The JiguangPush privacy policy is available at https://www.jiguang.cn/license/privacy.

Dealers and DistributorsWe may share your personal information with dealers and/or distributors that service your area in order to provide service calls for your [Aqua Alert™] products to help them know who in their service area has used [Aqua Alert™] products, as well as monitor your [Aqua Alert™] products for metrics such as water usage, water level, leaks, salt level, or mechanical errors, and adjust programming for your [Aqua Alert™] product. Dealers may reach out to you via email and/or phone (to the extent you have provided your contact information in connection with using the Application or [Aqua Alert™] product) for service or support.
Data analytics providersWe will share certain pieces of your Application Usage Information and Anonymized Information to create general data analytics regarding usage of our Application on an aggregate basis and without personal identifiers. For example, we use Google Analytics, a service provided by Google, Inc., to gather information about how you and other users engage with our Application. Law enforcement and government authoritiesWe will share your personal information with third parties where required by law (including to respond to valid legal process such as a search warrant or a court order), where it is necessary in connection with our Application or where we have another legitimate interest in doing so.
Other legal or regulatory authoritiesWe will share your personal information for us to comply with our legal obligations, including assessing compliance with our regulatory requirements (e.g., using Application usage information in the aggregate in connection with our regulatory requirements).
Buyer or successor of our businesssWe will share your personal information with any buyer or successor in the event of a merger, reorganization, dissolution, or other sale or transfer of title.

We do not sell the personal information of users we actually know are less than 16 years of age, unless we receive affirmative authorization from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Our Application is not directed to children under the age of eighteen (18) years. See Section 9 “Children” below for more information.

Most, if not all, of the third parties with whom we may share your personal information are located and store your information in the United States, although some may store your information outside of the United States.

5. Your rights and options regarding your personal information.

You have choices about how we use your personal information to communicate with you, send you marketing information, and whether you want to stay signed into your account. You can opt out from receiving future marketing communications from us at any time by:

  • Using the unsubscribe function in the email you receive from us; or

  • Contacting us as set forth under “How to contact us” above.

In addition, as noted above in “The information we collect about you,” you can choose whether to share certain types of your personal information with us by changing the settings available through the Application menu and whether to accept cookies by changing the settings on your browser or device. However, if you choose to disable cookies, your experience with our Application may be impaired and some features may not work as they were intended.

You may select a “do not track” setting on your web browser. However, these features are not yet uniform, so we do not currently respond to such features or signals. Therefore, if you select or turn on a “do not track” feature in your web browser, we and our third-party providers may continue collecting information about your online activities as described in this Privacy Notice.

Depending on where you live, you may have certain rights with respect to personal information that we have collected and used under certain circumstances, which may include the following:*
